These terms of use are the terms on which New Zealand Institute for Plant & Food Research Limited (we, us and our) offers you access to apirediet.com. aspireforlife.com means any Aspire for Life website (including www.aspireforlife.com) and all associated products and services, and includes the software and other material underlying and forming part of any Aspire for Life website or those products and services.

1. Acceptance of terms: By accessing aspireforlife.com you accept these terms. If you do not accept these terms, you may not use aspireforlife.com.

2. Changes to terms: We may amend these terms from time to time. Amendments will be effective when posted on aspireforlife.com. You are responsible for ensuring that you are familiar with our latest terms of use. Your continued use of aspireforlife.com means that you accept any amendments to the terms.

3. Rights of use: You must be over the age of 18 to use aspireforlife.com. Aspireforlife.com is for your personal use only. You must not share any aspireforlife.com service or any material received or accessible from aspireforlife.com with any other person or organisation. 

4. Warranty of Authority: By accessing aspireforlife.com you warrant that:

• all information you give us is true, correct and not misleading;
• you are over the age of 18;
• you do not suffer from or have never suffered from any eating disorder or any other medical condition which we consider inappropriate for aspireforlife.com users .  If you develop such a disorder or condition, you must immediately consult a medical professional regarding any continued use of aspireforlife.com;
• you are not pregnant; and
• the laws of your country permit your access to, and use of, aspireforlife.com in accordance with these terms. 

5. Operations: The use of aspireforlife.com is not an absolute right. We may in good faith, in our absolute discretion (including following any breach by you of these Terms), at any time and without notice:

• suspend, extend, restart or cancel any subscription;
• bar any person from using aspireforlife.com or reject any application for subscription; or
• take any other action we consider desirable to protect the security or integrity of aspireforlife.com.

6. Continuous improvement: We may change aspireforlife.com and its contents (including adding or withdrawing any product or service) at any time without notice. We may ask whether you wish to give feedback on your aspireforlife.com experience. Please respond fully.

Using Aspire for Life

7. Subscribe to access: To access aspireforlife.com’s products and services you will need to subscribe (by completing and submitting the online subscription form) and pay the applicable fee. 

8. Secrecy: You must keep your username and password confidential. If for any reason your login details may have been discovered you must immediately reset your password and let us know. 

Fees and payment

9. Fees: You are liable for the fees and charges imposed by us for aspireforlife.com products and services. Different fees will apply to different types of subscription. 

10. Currency: all prices are in NZ dollars and include goods and services tax.

11. Fee changes: We reserve the right to change our fees or to introduce new fees or products and services at anytime. We will give you at least one month’s notice before any fee changes take effect by:

• displaying the change on www.aspireforlife.com;
• emailing to your last known email address; or
• advertisements in other widely circulated or viewed media.

Any price change to any service you have ordered from aspireforlife.com will only take effect from renewal of that service. Your continued use of aspireforlife.com means that you accept any fee changes.

Our subscriptions

12. Type of membership: You can elect to subscribe for a 4 week Starter Membership or a 12 week Full Subscription Service. We also offer autorenewal options of 4 weeks or 12 weeks, and club membership options of 4 or 12 weeks.  

13. Benefits: Different services and/or rights of access may apply to different membership types.

Payment options

14. Autorenewal and renewal: options of 4 weeks or 12 weeks are available.  With autorenewal, the fees will be deducted automatically from your credit card at 12.00am of the first day of the renewal period and will happen whenever your current subscription expires.  Renewal is a one time selection and will take place at the time you activate the function.

15. Full Subscription Service: If you subscribe for the 12 week Full Subscription Service, we will debit your credit card for the applicable fee for the 12 week period when you complete the subscription process.

16. Starter Membership: If you subscribe for the 4 week Starter Membership we will debit your credit card for the applicable fee for the 4 week period when you complete the subscription process. 

17. Reminders: aspireforlife.com will endeavour to send you a reminder notice by email to your last known address at least one week before each payment date.

18. Payment for products: From time to time aspireforlife.com and/or its partners may offer products for sale through aspireforlife.com. If you order a product you will be required to pay the applicable fee by submitting your credit card details. We may refuse to accept any order unless and until payment is received in full.

19. Problems with payments: If for any reason we cannot process your payment we will endeavour to contact you at your last known email address. If we do not receive a satisfactory response from you within 7 days, we reserve the right to suspend or terminate your access to aspireforlife.com without further notice.

Renewals, cancellations and refunds

20. Renewing your subscription: You have choices of auto-renewal or renewal of 4 or 12 weeks.  Fees charged will be those current at the time of renewal for the service(s) renewed as displayed on aspireforlife.com. We will automatically renew your subscription if you click on the auto-renew options when signing up with us. We will endeavour to send you an email at least one week prior to your subscription expiring. The auto-renewal fee will be deducted from your credit card on the first day of the renewal period.  If you do not wish to auto-renew, go to ‘Your Account’ at the top banner after login and cancel auto-renew.

Renewal option can be activated from 'Your Account'.  If you choose the renewal option, a one-time renewal fee will be deducted from your credit card.  This will be deducted at the time you activate the function.

21. Cancellations: You may cancel your auto-renewal by deactivating the auto-renewal option through 'YOUR ACCOUNT' after login. To do this click on “Your Account” at the top banner and follow the instructions/link. Cancellation will be effective from the expiry date for your current subscription and will not apply to any payment deduction that is already made.

22. Refunds: Except where required by applicable law, we do not give any refunds (including for cancelled subscriptions or returned products). When you cancel your subscription, access to your subscribed services will continue until the end of your subscription term.

Contact with us and discussion forums

23. Interactive communications: aspireforlife.com allows you to email questions to our professionals and participate in discussion forums hosted by us (together referred to as interactive communication). We do not necessarily endorse or accept any of the interactive communications as our own or representative of our views. We may:

• monitor and/or participate in any interactive communication;
• answer or refuse to answer any question in any manner or forum whatsoever;
• post any question and any answer on any discussion board or elsewhere on aspireforlife.com where we consider it may be of general interest;
• use, copy or quote any interactive communication for any purpose whatsoever; and
• remove your access rights or edit, modify or delete any materials which we determine in our absolute discretion violate this agreement or the discussion guidelines.

24. Discussion guidelines: You are solely responsible for the content of any interactive communication. You shall not post to any discussion forum or otherwise publish on aspireforlife.com any communication which, in our opinion:

• is for commercial purposes or advertises or solicits for sale goods or services;
• is obscene, indecent, pornographic, profane, sexually explicit, or abusive;
• constitutes or contains false or misleading indications of origin or statements of fact;
• slanders, libels, defames, disparages, or otherwise violates the rights of any third party;
• causes injury of any kind to any person or entity;
• infringes or violates the intellectual property rights, contract rights, or any other rights of any third party;
• violates any applicable laws, rules or regulations;
• contains software viruses or any other malicious code designed to interrupt, destroy or limit the functionality of any computer software or hardware or any telecommunications equipment; or
• impersonates other people or in any way breaches or attempts to breach the security of aspireforlife.com.

25. What we do: We make every effort to include current and accurate information on aspireforlife.com and to ensure that aspireforlife.com products and services are properly provided to you. 

26. No guarantees: However, we can not, and do not, make any claims, warranties or representations whatsoever regarding aspireforlife.com, or your use of aspireforlife.com. In particular, we do not warrant that aspireforlife.com is complete or accurate, that it is fit for any particular purpose, that it will meet your requirements, or that your access will be uninterrupted or error free. We do not guarantee any outcome from using  aspireforlife.com. Aspireforlife.com is provided on an “as is” and “as available basis”. All warranties and representations implied by law are excluded to the extent permitted by law. 

27. Not medical advice: Information contained in aspireforlife.com is not intended and must not be taken to be the provision or practice of medical advice or services nor a substitute for medical advice, diagnosis or treatment. If you have any questions or concerns about your health, or would like more information, contact your doctor.

28. Our liability: You use aspireforlife.com at your own risk. Subject to complying with our duty to exercise reasonable care and skill under the Consumer Guarantee’s Act 1993 (New Zealand), neither we nor our aspireforlife.com partners (being any person involved in providing any aspireforlife.com product or service) will ever in any circumstances be liable to you or any other person in contract, negligence or other tort, equity or in any other way for any loss, damage or liability of any kind or for any illness, injury or death arising from your use of, or inability to use, aspireforlife.com or any other website linked to aspireforlife.com.

If for any reason we cannot rely on the above exclusion of liability, our liability, and our aspireforlife.com partners’ liability, to you will be limited to $100 and in no event will we (or our aspireforlife.com partners) be liable to you for any loss of profits, savings, goodwill or business opportunity or for any indirect or consequential loss.

You agree that if you are using aspireforlife.com for the purposes of the business as defined in the Consumer Guarantees Act 1993 (New Zealand), the provisions of that Act do not apply to anything we agree to provide. 

29. Links to other sites and advertisements: aspireforlife.com includes links to other websites and advertisements for and information supplied by third parties. We do not control, review or endorse the advertised product or service and have not necessarily verified any of the information available through the use of any link found within  aspireforlife.com. 

Intellectual property

30. We (and our licensors, suppliers, or aspireforlife.com partners, as applicable) own all copyright and other intellectual property rights in aspireforlife.com. You may download, print and store any part of aspireforlife.com for your personal, non-commercial use. Otherwise you may not in any form or by any means copy, reproduce, modify, create derivative works, distribute, or publicly display anything from aspireforlife.com without our (and any applicable third party’s) prior written consent.

Complaints

31. Please email us at enquiries@aspirediet.com if:

• you have any concerns or questions about any product or service provided by aspireforlife.com;
• you suspect that your username and/or password has been disclosed, or your online account has been accessed by a third party; or
• you think there has been a discrepancy or error with payment.
• Aspireforlife.com will respond to all legitimate complaints within a reasonable period of time.
  

32. You accept our privacy policy as stated at the end of this page.

33. Your subscription is personal to you: Your subscription to aspireforlife.com may not be assigned or transferred to any person.

34. Our rights: We may assign or transfer any or all of our rights and obligations under these terms at any time and without notice. 

35. Contracts privity: Your obligations under these terms are for the benefit of us and our aspireforlife.com partners.

36. Severability: If any part of these terms is held to be invalid, unenforceable or illegal for any reason, then that part shall be severed or amended to the minimum extent necessary for the balance of these terms of use to continue in full force and effect.

37. Entire agreement: These terms of use contain everything we have agreed in relation to your use of aspireforlife.com. You cannot rely on anything else said or done by us (or any of our representatives).

38. Governing law: The agreement between us and any user of aspireforlife.com is deemed to be made in New Zealand. New Zealand law governs these Terms and the use of aspireforlife.com. You agree to the jurisdiction of New Zealand’s Courts.

Our privacy policy: Your rights to privacy under the Privacy Act 1993 are important to us and we are committed to ensuring the privacy of your information. 

Use of information: By using aspireforlife.com you consent to:

• us and our aspireforlife.com partners (being any person involved in providing any aspireforlife.com product or service), collecting and storing personal information provided by or concerning you and using that information solely for the purposes contemplated by aspireforlife.com, including:
  • seeking verification of information provided by you, including verification of credit card information provided by you and your authorisation to use that credit card;
  • seeking feedback in respect of your aspireforlife.com experience;
  • for statistical purposes;
  • to keep you informed of new products or services we think you might be interested in;
  • in connection with interactive communications (as contemplated by the terms of use for aspireforlife.com); and
  • otherwise in connection with the operation or development of aspireforlife.com; and
• the disclosure of personal information about you to our aspireforlife.com partners for the purposes set out above.

Your rights 

You have the right to access and correct your personal information held by aspireforlife.com and/or to be removed from our mailing list. To do so, contact us at enquiries@aspirediet.com or via our contact page.

Third party acts

You will be entitled to the protection of any privacy policy of any person to whom your personal information is sent as contemplated by these terms. We are not liable for any breach of the Privacy Act 1993 by any third party, or in respect of the use or misuse of your personal information by any third party. Nor are we responsible for the privacy practices or the content of any other websites.

Cookies

Cookies are used for the automatic login feature on aspireforlife.com. When enabled on a computer, this feature means that subscribers don’t have to manually log in each time they visit aspireforlife.com from that computer. Your browser must be set to accept permanent cookies for this feature to work.

You can choose not to enable this feature. If you do choose to use the automatic login, this feature can be turned off at any time on your computer before logging in or after logging out.

Important! You should not use the automatic login feature unless you are the only person who has access to that computer. Never enable this feature on a public access computer. This could allow other people to access the site under your login and access your aspireforlife.com account details.
